These Terms & Conditions ("Terms") govern the provision of tutoring, homework support, and related services ("Services") by After School HomeWork – UAE, operating under FutureMinds Education Services FZ-LLC ("the Company", "we", "us"), to the parent or legal guardian ("Parent", "you") enrolling a child ("Student") for Services. By submitting the Parent Intake Form, confirming a booking, or making payment, you agree to be bound by these Terms.

1. The Services

1.1 The Company provides managed after-school academic support, including Homework Assistance, Subject Tutoring, Premium Learning Support, and Tech Tutoring, delivered by tutors recruited, screened, and coordinated by the Company.

1.2 Services may be delivered online, at the Student's home, or at another agreed location, as selected by the Parent during onboarding.

1.3 The Company assigns tutors based on subject need, location, availability, and stated preferences, and reserves the right to assign a replacement tutor where necessary to maintain continuity of service.

1.4 The Company does not guarantee specific academic outcomes, grades, or examination results. The Services are designed to provide structured support, confidence-building, and improved study habits.

2. Fees & Payment

2.1 Parents pay for tutoring hours in advance, either on an hourly basis or through a prepaid monthly package, as agreed at the time of booking.

2.2 Transportation, where required for home tutoring, is charged separately from the tutoring fee and is calculated per visit based on distance, in accordance with the Company's published transport fee schedule.

2.3 Payment must be received before the first session of any billing period begins. The Company reserves the right to suspend Services for any account with an outstanding balance.

2.4 Monthly packages are valid for one calendar month from the start date. Unused hours expire at the end of the month unless a rollover has been approved in advance by the Company.

2.5 One rollover of unused hours per month may be granted at the Company's discretion for genuine, documented reasons (e.g. illness, travel).

2.6 All fees are quoted and payable in UAE Dirhams (AED) unless otherwise agreed in writing.

3. Cancellations & Rescheduling

3.1 Parents may cancel or reschedule a session free of charge with at least 12 hours' notice before the scheduled start time.

3.2 Cancellations made less than 12 hours before a scheduled session will be counted as a used session and deducted from the Parent's package hours.

3.3 If a tutor arrives for a scheduled session and the Student is unavailable, unprepared, or not present, the session (and any applicable transport fee) will be charged in full.

3.4 If a tutor is unable to attend a scheduled session, the Company will offer a replacement tutor or reschedule the session at no additional cost to the Parent.

3.5 The Company may, at its discretion, apply exceptions to this policy in genuine emergency circumstances.

4. Refunds

4.1 Prepaid sessions that have not yet commenced may be refunded in full upon written request.

4.2 Once a package of sessions has commenced, fees for completed sessions are non-refundable.

4.3 Remaining unused sessions within an active package may, at the Company's discretion, be transferred to another eligible service, rescheduled, or credited toward a future package.

4.4 Transport fees for completed visits are non-refundable under any circumstances.

4.5 If the Company is unable to provide a suitable tutor for a booked package, the Parent will receive a full credit or refund for any unused hours.

5. Parent Responsibilities

By enrolling a Student for Services, the Parent agrees to:

  • Provide accurate information about the Student's age, curriculum, academic needs, and any relevant learning or behavioural considerations.
  • Ensure a parent, guardian, or other approved responsible adult is present at the Student's home for the duration of any in-person session.
  • Provide a safe, appropriate, and reasonably quiet space for the session to take place.
  • Ensure the Student is available, prepared, and ready at the agreed session time.
  • Communicate any concerns about a tutor or session promptly to the Company, rather than directly confronting the tutor.
  • Make all payments in accordance with Section 2 of these Terms.

6. Tutor Conduct & Safeguarding

6.1 All tutors engaged by the Company are screened, interviewed, and required to sign the Company's Tutor Code of Conduct prior to being assigned to any Student.

6.2 Tutors are required to conduct sessions in an open or shared space within the home, and are not permitted to be alone with a Student in a closed private room without express Parent consent.

6.3 Tutors are prohibited from administering any form of physical discipline, and from any conduct that is disrespectful, inappropriate, or unsafe toward a Student.

6.4 Tutors are prohibited from accepting direct payment from Parents, arranging private sessions outside the Company's platform, or sharing images of a Student without the Parent's prior written consent.

6.5 The Company transports tutors to and from sessions where agreed; the Company does not transport Students under any circumstances.

6.6 Any safeguarding concern should be reported to the Company immediately. The Company will investigate all concerns promptly and take appropriate action, which may include reassignment or removal of a tutor.

7. Exclusivity of Booking

7.1 Parents agree not to engage, directly or indirectly, any tutor introduced through the Company for private tutoring arrangements outside of the Company's services, during the engagement and for a period of six (6) months after its conclusion.

7.2 This provision exists to protect the sustainability of the Company's tutor network and the quality assurance processes described in Section 6.

8. Reporting & Communication

8.1 Tutors will submit a session report after each lesson or on a weekly basis, summarizing topics covered, progress observed, and any recommended next steps.

8.2 The Company will provide the Parent with a weekly summary report consolidating this information.

8.3 Communication regarding scheduling, billing, and general service matters will primarily take place via WhatsApp or the contact details provided by the Parent during onboarding.

9. Data Privacy

9.1 The Company collects personal information about the Parent and Student, including contact details, academic information, and (where disclosed) relevant learning or behavioural information, solely for the purpose of providing and improving the Services.

9.2 This information will be kept confidential and will not be shared with third parties except: (a) with the assigned tutor, to the extent necessary to deliver the Services; (b) where required by UAE law or a competent authority; or (c) with the Parent's explicit consent.

9.3 Parents may request access to, correction of, or deletion of their personal data by contacting the Company directly, subject to any records the Company is legally required to retain.

10. Limitation of Liability

10.1 The Company will exercise reasonable care and skill in selecting and assigning tutors and in the delivery of the Services.

10.2 To the fullest extent permitted under UAE law, the Company's liability for any claim arising from the Services shall be limited to the fees paid by the Parent for the specific package or session giving rise to the claim.

10.3 The Company shall not be liable for any indirect, incidental, or consequential loss, including but not limited to loss of expected academic results.

10.4 Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under the laws of the United Arab Emirates.

11. Suspension & Termination

11.1 The Company may suspend or terminate Services immediately, without refund of fees already earned for services rendered, in the event of: non-payment; abusive or unsafe conduct toward a tutor or staff member; or breach of these Terms.

11.2 Either party may terminate an ongoing arrangement with written notice; fees for sessions already completed remain payable, and Section 4 (Refunds) governs the treatment of any remaining prepaid balance.

12. General Provisions

12.1 These Terms are governed by the laws of the United Arab Emirates and the applicable regulations of the Ajman Free Zone.

12.2 If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

12.3 The Company may update these Terms from time to time. Continued use of the Services after notice of an update constitutes acceptance of the revised Terms.

12.4 These Terms, together with the Parent Intake Form and any package confirmation, constitute the entire agreement between the Parent and the Company regarding the Services.
